LIMITATION OF ACTIONS

1-3-102. When actions may be commenced.

Civil actions can only be commenced within the periods prescribed in this chapter, after the cause of action accrues, but where a different limitation is prescribed by statute, that shall govern.

1-3-105. Actions other than recovery of real property.

(a) Civil actions other than for the recovery of real property can only be brought within the following periods after the cause of action accrues:

OPEN ACCOUNTS

Three Year Statute

(ii) Within three (3) years, an action:

(A) Upon a contract not in writing, either express or implied; or

(B) Merchandise Open Accounts

Contracts In Writing

Written Contract: 15 years

Mortgage: 20 years

JUDGMENTS

The legal rate of interest is 6%;

all other rates are set by the Finance Board of Office of Commissioner of Financial Institutions every 6 months.

Judgments bear interest at the same rate as the underlying debt.

Domestic Judgment: 15 years

Foreign Judgment: 15 years
